TIAC Nominated for Global Arbitration Review’s “Best Innovation” Award

The Global Arbitration Review has recognized the Tashkent International Arbitration Centre (TIAC) with a nomination for the prestigious “Best Innovation” award. This acknowledgment highlights TIAC’s contributions to advancing international arbitration practices through initiatives such as the development of cross-institutional arbitration rules in collaboration with the Hong Kong International Arbitration Centre (HKIAC). These rules are designed to enhance efficiency and effectiveness in arbitration proceedings, showcasing TIAC’s commitment to forward-thinking solutions in dispute resolution.

Mentorship Program for Aspiring Arbitration Practitioners

In 2024, TIAC launched a mentorship program to support 50 arbitration practitioners in securing their first appointments. Inspired by Amanda Lee’s advocacy, the initiative allows participants to shadow arbitrators in small-value disputes, fostering practical experience and promoting diversity in the arbitration field.

TIAC Administers Case Involving Party from Outside the CIS Region

In one of the latest cases administered by TIAC, one of the parties involved is a notable country outside the CIS region, further expanding TIAC's international reach.

Uzbek Economic Court Enforces International Arbitration Award

The Uzbek Economic Court has enforced an award issued by the International Commercial Arbitration Court under the Chamber of Commerce and Industry of the Russian Federation in Case №194/2022. The award, totaling $1,293,031, includes a penalty of $29,355, arbitration costs of $31,924, and legal fees amounting to RUR 324,440. The copy of the judgment in Russian is available here.

UK Minister of Justice Commends TIAC at Uzbek Arbitration Week

During the 3rd edition of Uzbek Arbitration Week, the UK Minister of Justice, Mike Freer, emphasized the pivotal role of TIAC in fostering robust arbitration practices and cultivating local expertise. The Minister commended TIAC’s rapid progress since its establishment in 2018, including its ability to attract leading arbitrators trained in the UK. He reaffirmed the UK’s commitment to supporting TIAC’s growth and strengthening ties between the UK and Uzbekistan.

TIAC and HKIAC Introduce Cross-Institutional Rules

The Tashkent International Arbitration Centre (TIAC) and the Hong Kong International Arbitration Centre (HKIAC) have launched the TIAC-HKIAC Cross-Institutional Rules, a new framework designed to combine TIAC's cost-effectiveness and expertise in the CIS region with HKIAC’s international experience.

Under these rules, HKIAC will be responsible for key decisions, such as appointments and challenges, while the TIAC Secretariat will oversee administration and assist with procedural matters. This collaborative approach allows TIAC to co-administer arbitration cases with one of the world’s leading arbitration institutions, offering enhanced dispute resolution options across various sectors.

Memorandum of Understanding with Navoi Free Economic Zone

TIAC has signed a Memorandum of Understanding with the Navoi Free Economic Zone (NFEZ), the largest industrial free economic zone in Uzbekistan, home to the Navoi Mining and Metallurgical Company, one of the top 10 largest uranium and gold producers globally. This agreement aims to establish a platform for alternative dispute resolution for NFEZ residents, with proceedings administered in English.

Cooperation with the Supreme Court of Uzbekistan

TIAC has signed a Memorandum of Cooperation with the Supreme Court of Uzbekistan to enhance the exchange of information on the enforcement of arbitral awards in Uzbekistan. As part of this collaboration, the two institutions will share statistics, redacted court judgments, and other relevant materials, with a focus on improving the accessibility and understanding of enforcement practices. Additionally, the translation of key materials into English will support broader international engagement and ensure greater accessibility for global stakeholders.

TIAC and HKIAC sign cooperation agreement to adopt the TIAC-HKIAC Cross-Institutional Arbitration Rules

TIAC is pleased to announce that it has entered into a cooperation agreement (Agreement) with the Hong Kong International Arbitration Centre (HKIAC) to place on record the exclusive arrangement between two institutions under the TIAC-HKIAC Cross Institutional Arbitration Rules (TIAC-HKIAC Rules), which will come to force in September 2022. Mariel Dimsey, HKIAC Secretary-General, and Diana Bayzakova, TIAC Director, signed the Agreement online from Hong Kong and Tashkent, respectively.

Under the TIAC-/HKIAC Rules, TIAC and HKIAC will jointly administer cases and TIAC will refer to HKIAC on certain procedural issues arising in arbitrations filed pursuant to the TIAC-HKIAC Rules. HKIAC will make its decisions without charging administrative fees except in limited, pre-defined circumstances. 

TIAC was established in 2018 under the Chamber of Commerce and Industry of Uzbekistan and since then has been developing rapidly in line with Uzbekistan’s growth and increased attracting foreign investment, especially in high-tech industries. TIAC’s caseload includes disputes with parties from the Netherlands, Italy, Kazakhstan, Russia, China, Turkey, Uzbekistan.  

HKIAC’s extensive expertise in disputes involving Chinese parties and growing experience with CIS disputes, together with TIAC’s technological development strategies, will offer new dispute resolution opportunities for arbitration users across the CIS and Asian regions. 

Strengthened Conflict of Interest Rules

TIAC enforces strict 'no conflict of interest' rules that go beyond the IBA guidelines on conflicts. These rules ensure that members of the TIAC Court of Arbitration, the Secretariat, and other TIAC employees are not permitted to serve as arbitrators during their terms of service.

Global Arbitration Review (GAR) has published an article about Uzbek Arbitration Week (UzAW), organised by the Ministry of Justice, Chamber of Commerce and Industry and Tashkent International Arbitration Centre (TIAC) at the CCI of Uzbekistan.

The article has featured UzAW as a forum that enabled Uzbekistan to showcase its updated arbitration offering, including a new law based on the UNCITRAL Model Law and new rules and rosters at the Tashkent International Arbitration Centre, and highlight its advantages as a seat for CIS-related disputes.

Uzbek Arbitration Week has been billed as one of the first in-person arbitration events since the pandemic started.

The event (which preceded Paris Arbitration Week by one week) showcased not only the new law but new rules of TIAC, designed to cater for the growing number of technology-related disputes and setting out cutting-edge procedures for handling complex and potentially sensitive technological data and evidence, which may include trade secrets, and maintaining cybersecurity.

TIAC also unveiled a roster of 60 leading arbitrators from different parts of the world from which parties to cases can (if they wish) select tribunal members and a roster of younger arbitration specialists who are willing to sit as tribunal secretaries in cases administered by the centre.

Mediation Rules and Expert Appointment Service

TIAC launched its Mediation Rules in 2021, followed by the introduction of its Expert Appointment service in June 2022. These initiatives led to the registration of the first request for expert determination in July 2022, related to a large-scale infrastructure project financed by an International Financial Institution (IFI).

Expansion into Sports Arbitration

TIAC launched its sports arbitration wing, marking a significant milestone with the registration of its first sports arbitration case in May 2021. This development led to TIAC’s exclusive mandate to resolve sports disputes at the Tashkent International Marathon World Athletics Label Road Race 2022. The establishment of this dedicated wing reinforces TIAC’s commitment to expanding its services in specialized sectors, offering a trusted platform for resolving sports-related disputes.

Tashkent International Arbitration Centre (TIAC) at the Chamber of Commerce and Industry of Uzbekistan and TIAC45 launch the TIAC Roster of Tribunal Secretaries  

As part of the inaugural Uzbek Arbitration Week, on 10 September 2021, TIAC and TIAC45 held a hybrid seminar to discuss the role of Tribunal Secretaries, the keynote address was delivered by Prof. Pierre Tercier. The seminar concluded with the launch of the Roster of Tribunal Secretaries. The Roster is the first database of arbitration practitioners offering their services as Tribunal Secretaries. Its goal is to provide a platform for experienced and aspiring Tribunal Secretaries and to offer the arbitrators and arbitration institutions an easily accessible pool of talent. The Roster is one of the ongoing projects of the TIAC45 Working Group which includes TIAC45 Vice-Chair Olga Kim, Rahul Donde, Nata Gibradze, Michael Wietzorek, and Ivan Yurevich.  

Diana Bayzakova, TIAC Director appointed in November 2018 to lead the centre, commented: “The TIAC Court members and Secretariat are dedicated to taking actionable steps to diversify arbitral appointments and the Roster of Tribunal Secretaries is one of such initiatives aimed at providing young practitioners with access and first-hand knowledge of arbitral proceedings.”

Olga Kim, TIAC45 Vice-Chair, added that “We are very excited to be a part of the TIAC and TIAC45’s ongoing commitment to promoting diversity in international arbitration. This is just the first milestone of the work planned by our working group. We are planning to continue various efforts in research, training, promotion and development of the network of Tribunal Secretaries in future and we encourage young practitioners to join TIAC45 membership and participate in development of this and other exciting projects.

TIAC was established in November 2018 and launched officially in Paris in April 2019. Since April 2019, TIAC has received 22 Requests for Arbitration (22 commercial cases and 1 sport arbitration case) and 2 applications for emergency relief. All the commercial cases were international in nature with parties hailing from Italy, Netherlands, Moldova, Turkey, Russian Federation, Kazakhstan, Philippines, Singapore, Uzbekistan, China, and Hong Kong. Notably, in one of the latest cases, the parties were from the Russian Federation and Singapore. TIAC45 was launched in March 2021. Tashkent International Arbitration Centre (TIAC) at the Chamber of Commerce and Industry of Uzbekistan and TIAC45 launch the TIAC Diversity Toolkit to assist the TIAC Court and Secretariat in making institutional arbitrator appointments

As a grand finale to the inaugural Uzbek Arbitration Week, TIAC and TIAC45 launched a new Diversity Toolkit on 10 September 2021 to assist the TIAC Secretariat and Court members in making broader choices in terms of international arbitrator appointments. The TIAC Diversity Toolkit was developed by the members of the TIAC45 arbitration practitioners’ group including TIAC45 Chairperson Kirsten Teo, Bryan Branon, Diana Tsutieva, Jennifer Ivers, Orlando Cabrera, Preetika Mishra and Rocio Digon. The TIAC Diversity Toolkit is an internal resource for the TIAC Secretariat and Court members.

Diana Bayzakova, TIAC Director appointed in November 2018 to lead the centre, commented: “The TIAC Court members and Secretariat continually strive to diversify arbitrator appointments - for instance in terms of gender diversity, female arbitrators make up 40% of the total number of TIAC arbitrator appointments made to-date. Diversity is at the heart of everything we do and the development of the TIAC Diversity Toolkit is an innovation that seeks to further enhance the process in which TIAC considers and makes institutional arbitrator appointments in TIAC-administered cases. I thank the TIAC45 working group members for their innovation and assistance in developing this Diversity Toolkit to assist TIAC in ensuring greater diversity in arbitrator appointments.”

Kirsten Teo, TIAC45 Chairperson, added that “We at TIAC45 are grateful for the opportunity and responsibility entrusted on us, and strive to meaningfully contribute to all TIAC diversity initiatives especially the creation of the TIAC Diversity Toolkit. By the Order of the Chairman of the Chamber any disputes that fall under the jurisdiction of the ICAC are to be referred for administration and resolution by TIAC in accordance with the TIAC Rules of Arbitration.

Administrative staff of ICAC and TIAC are to establish an interchange between arbitral institutions on the matters arising out of jurisdictional issues.

Tashkent International Arbitration Center created under Chamber of Commerce and Industry of Uzbekistan

President Shavkat Mirziyoyev signed a decree yesterday creating the Tashkent International Arbitration Center (TIAC) ​​under the Chamber of Commerce and Industry of Uzbekistan.

The center, as the non-governmental non-profit organization, will assist the TIAC Court of Arbitration with the administration of disputes arising from contractual and other relations of business entities operating in Uzbekistan and beyond, including disputes related to investments, intellectual property and blockchain-related issues.
